This Privacy and Cookies Policy describes how www.roar-cruise.com (“Online Store”, “Store Website” or “We” in all grammatical variations) collects and processes your personal information when you visit the Online Store or make a purchase from the Online Store, the type of personal information we collect, the reasons we collect personal information, and how we handle your personal information.
All words and expressions appearing in this Privacy and Cookies Policy and beginning with a capital letter shall be understood as defined in the Terms and Conditions of the ROAR Online Store www.roar-cruise.com available on the Online Store Website.

Collecting Personal Information

When you visit the Online Store, we collect certain information about your device, your interaction with the Online Store, and the information necessary to enter into and perform the Sales Agreement concluded through the Online Store. We may also collect additional information if you contact us for assistance. In this Privacy and Cookies Policy, we refer to any information that identifies an individual (including the information listed below) as “Personal Information”.   • Information about the device 
    • Purpose of collecting Personal Data: accurate loading of the Store Website, as well as analysis of the use of the Store Website to optimize our Store Website.

    • Source of collection of Personal Data: collected automatically when you visit our Store Website via cookies, log files, web beacons, tags, or pixels.

    • Commercial disclosure of Personal Data: shared with our Shopify processor who processes Personal Data on behalf of the Administrator.

    • Personal Data collected: browser version, IP address, time zone, cookie information, pages or products viewed, search terms searched, and how you interact with the Store's Website. 

    • Legal basis: necessary for the conclusion and performance of the Sales Agreement (Article 6.1.b GDPR); for the fulfillment of our statutory obligations (Article 6.1.c GDPR); legitimate interest for analytical and statistical purposes, for the establishment, investigation, or defense of claims (Article 6.1.f GDPR).

    • Data retention period: the time necessary to conclude and fulfill contractual and regulatory obligations for the purchase and sale of products (e.g., tax regulations).

  • Order Information

    • Purpose of collecting Personal Data: to provide you with products or services to fulfill the concluded Sales Agreement, to process payment information, to arrange delivery and provide invoices and/or Order confirmations, to contact you, to review our Orders for potential risk or fraud, and, according to your settings, to provide you with information or advertising related to our products or services.

    • Source of collection of Personal Information: received from you.

    • Disclosure of Personal Data for commercial purposes: shared with our Shopify processor, who processes Personal Data on behalf of the Administrator.

    • Personal Data collected: name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.

    • Legal basis: execution of the Sales Agreement (Article 6.1.b of the GDPR); to fulfill our statutory obligations (Article 6.1.c of the GDPR), to establish, assert or defend claims (Article 6.1.f of the GDPR).

    • Data retention period: the time necessary to fulfill contractual and regulatory obligations regarding the purchase and sale of products (e.g., tax regulations).

  • Service Information

    • Purpose of collecting Personal Information: to assist you and address any questions or concerns you may have.

    • Source of collection of Personal Data: service information is collected directly from you. This may be through various channels, such as phone calls, emails, online chat, or personal interaction.

    • Disclosure of Personal Information for Commercial Purposes: disclosure of your service information for commercial purposes is limited to the extent necessary to resolve a specific inquiry or problem.

    • Legal basis: performance of the Sales Agreement (Article 6.1.b of the GDPR); for the fulfillment of our statutory obligations (Article 6.1.c of the GDPR); legitimate interest in defending our rights in or out of court, in case of legal claims or litigation (Article 6.1.f of the GDPR).

    • Data retention period: the time necessary to fulfill your requests.


Sharing Personal Information

We may share your Personal Information with service providers to help us provide our services and perform our agreements with you, as described above. For example:

  • We may share your Personal Information to comply with applicable laws and regulations, in response to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

Behavioural Advertising

As described above, we use your Personal Information to deliver targeted advertising or marketing communications that we believe may be of interest to you. For example:

We also share information about your use of the Shopify Website, your purchases, and the email address associated with your purchases with Shopify audience groups, through which other Shopify merchants may present you with offers that may be of interest to you.

Using Personal Information

We use your Personal Information to provide our services, which include: representing Goods, processing payments, shipping and fulfilling your Order, and informing you of new products, services and offers.

Retention

When you place an order through the Online Store, we keep your Personal Information for our records unless and until you ask us to delete the information. Please see the “RIGHTS REGARDING PERSONAL DATA” section below for more information on your right to erasure.

Automatic decision-making

You have the right to object to processing based solely on automated decision-making (including profiling) when that decision-making produces legal effects on you or otherwise materially affects you.

We do NOT engage in fully automated decision-making using your data that has legal or other significant consequences.

Our Shopify processor uses limited automated decision-making to prevent fraud that has no legal or other significant consequences for you.

Services that include elements of automated decision-making include:

  • a temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a few hours;

  • a temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist is in effect for a few days.

If your Personal Data is incomplete, incorrect, or outdated, you have the right to request rectification or completion.

Your Personal Data will first be processed in Ireland and then transferred outside Europe for storage and further processing, including to Canada and the United States. In such situations, your data will only be transferred to countries that provide an adequate degree of protection, and to countries that do not provide an adequate degree of protection, only if adequate safeguards are provided, including but not limited to standard contractual clauses adopted by the European Commission.
